Multijurisdictional protection of an international master franchise agreement in the automobile sector

In connection with a refusal to enforce an international Master Franchise agreement in the aftermarket automobile sector involving tens of thousands of employees (21,000) and annual license fees of 180 million euros, a jurisdiction clause was activated to initiate an international dispute in Milan, which generated a counter case in the United States (Illinois). After several hearings which systematically led to the refusal of the defendant’s claims, both in Italy and in the United States, a transactional solution was reached allowing us to stabilize our client’s right to commercial development in more than 60 countries in the world, the majority of which are in Europe and Africa.
