OIC TREATY ARBITRATION FOR EXPOPRIATION OF CONSTRUCTION PROJECT BY LIBYAN STATE
LLB represented the UAE subsidiary of a large Indian conglomerate in its claims against the Libyan State for the expropriation of public housing developments in violation of the OIC Treaty for claimed damages of USD$1.2 billion. The arbitration was notable in that the PCA appointed tribunal members to permit the constitution of the Tribunal as a result of the Libyan state failure to respect its procedural obligations pursuant to the OIC Treaty. The PCA appointed tribunal confirmed their jurisdiction after being contested by the Libyan State in a landmark decision.
