RECOGNITION & ENFORCEMENT OF A FINRA (USA) ARBITATION AWARD in FRENCH COURTS

LLB obtained a Court of Appeal decision confirming a writ of execution for a FINRA Award (USA) in circumstances where US Courts had determined to refuse recognition and enforcement in the United States and had determined that the trustee of the beneficiary of the Award, was in contempt of other US Court Orders to seeking to collect FINRA Award outside of the United States. LLB continues to act to enforce the FINRA Award and related French court orders in the European Union. These proceedings have relevant implications for enforcement of arbitral awards throughout the world and the jurisdiction of courts to issue anti-suit injunctions to frustrate rights of parties that have vested in other jurisdictions.
