Benoit Le Bars, founding partner, published an article in the International Business Law magazine that addresses the use of anti-suit injunctions in international arbitration, and particularly focuses on the advantages of adopting them under OHADA law. This article discusses the various problems posed by the adoption of the common-law mechanism in a civil law environment.
The article, entitled, “Anti-suit Injunctions and OHADA Arbitration: A Procedural Avenue to be Explored for the Protection of the International Litigant”, was published in the February 2016 issue and prepared in cooperation with the CEDE (The European Center for Law and Economics at ESSEC). It follows three other articles prepared by members of the CEDE team which were already published in earlier issues of the International Business Law magazine.
